The Fizen Platform is provided by Fizen Limited, a company registered under the laws of Hong Kong, with its registered address at Unit 1411, 14/F, Cosco Tower, 183 Queen's Road Central, Sheung Wan, Hong Kong.

If you do not agree with any part of this Policy, you should not access the Fizen Platform or use the Services.

This Policy explains how we collect, use, store, and share the personal data of users ("user", "you", or "your") who access or use the Fizen Platform and/or Services, or who visit any applications or websites linked to this Policy.

Any capitalised terms not defined in this Policy have the same meaning as in the Fizen Terms of Use.

Information you provide when registering your Fizen Account, including, but not limited to, your username, full name, government-issued identification documents (e.g. passport or national ID number), date of birth, nationality, email address, telephone number, and business information (e.g. company name, logo, registered address, registration number). This also includes information about your legal representatives and any other details you share on your profile or through the Fizen Platform.

Transaction Information

Information about transactions you carry out in connection with the Services, including transaction amounts, dates, counterparties, and transaction details.

Financial Information

Your credit card or other payment card details, bank account numbers, digital wallet addresses, and any other financial information collected through your use of the Fizen Platform and/or Services.

Feedback

Any feedback or comments you provide about the Fizen Platform, other users, the Services, or third-party service providers.

Behaviour Data

Information about your activity on the Fizen Platform, for example, the types of products or services you view, engage with, or show interest in.

Technical Information

Your internet protocol (IP) address, device ID, device characteristics, time zone, language settings, web server logs, application logs, and other technical information collected automatically via Cookies or similar technologies.

If you access applications or websites related to the Fizen Platform and/or Services, we may also collect information you choose to provide or that is necessary for us to deliver the Services — including your name, email address, phone number, IP address, device ID, and browser information.

Information from Third Parties

You may choose to share data with us from third parties — for example, if you register your Fizen Account using a social network account (such as Facebook or Twitter), or if you link such accounts to the Fizen Platform. We use the location settings you select in your account to personalise your experience, verify your account, and determine whether you are able to access the Fizen Platform or Services, or whether you are subject to any restrictions under applicable laws in your jurisdiction.

Any information you provide when you contact us, other users, or third parties regarding support through the Fizen Platform, and any information required for compliance with applicable anti-money laundering laws.

(a) Provide the Fizen Platform and/or Services to you;

(b) Facilitate transactions and purchases between you and merchants or third-party service providers you engage through the Platform;

(c) Provide you with personalised suggestions on features and Services that may be of interest to you;

(d) Enable you to transfer your Digital Assets to and from your Fizen Wallet(s);

(e) Verify your identity and communicate with you;

(f) Detect and combat abuse, harmful activity, fraud, spam, and illegal activity on the Fizen Platform;

(g) Ensure your safety and security, including reviewing your activities and transactions for compliance with our Terms of Use, applicable policies, and laws;

(h) Carry out data analysis and testing to ensure Platform stability and security;

(i) Allow you to participate in interactive features of the Platform;

(j) Ensure you meet legal requirements to use the Platform or Services (e.g. minimum age and legal capacity);

(k) Provide location-based services where available in your jurisdiction;

(l) Facilitate user support;

(m) Enforce our terms, conditions, and policies;

(n) Ensure compliance with applicable laws; and

(o) Administer the Platform, including troubleshooting.

How We Share Your Personal Data

We share your information with third parties as needed to fulfil your transactions and deliver the Services on our behalf. This includes sharing data to respond to your queries, feedback, claims, or disputes.

If you register using a social network account (e.g. Facebook, Twitter), you will allow us or those providers to share your username and public profile information between the Fizen Platform and the social network.

We also share your information with third-party service providers we engage to help deliver the Platform and Services, including analytics providers, advertisers, advertising networks, cloud storage providers, and payment services providers.

We may share your information with our subsidiaries and affiliates to improve and optimise the Platform, prevent illegal activity, and support users.

We will share your information with courts, law enforcement agencies, public authorities, or other organisations if legally required, or if it is reasonably necessary to:

(a) Comply with legal obligations, processes, or requests;

(b) Enforce our Terms of Use and other agreements, policies, and standards, including investigation of potential violations;

(a) If we sell or buy any business or asset (whether through liquidation, bankruptcy, or otherwise), we may disclose your information to the prospective seller or buyer of that business or asset; or

Where We Store Your Personal Data

The personal data we collect from you may be stored on servers located in countries other than your country of usual residence, including countries where we operate. By using the Fizen Platform and providing us with your personal data, you consent to this transfer and storage.

We will take all steps reasonably necessary to ensure that your data is handled securely and in accordance with this Policy.

Your Choices and Rights

You can access, update, or correct your profile information at any time by signing into your Fizen Account. We provide tools within the Platform to help you manage and control your information. You may also delete all information in your Fizen Account via the settings section, or by sending us a request.

In addition, you have the right to:

(a) Object to the processing of your personal information;

(b) Request that we restrict processing of your personal information; or

(c) Request portability of your personal information.

If we collected and processed your personal information based on your consent, you may withdraw that consent at any time. Withdrawing consent will not affect the lawfulness of any processing carried out before your withdrawal, nor any processing conducted on lawful grounds other than consent.

You also have the right to complain to the relevant data protection authority in your jurisdiction if you have reasonable grounds to believe your personal information has been processed in breach of this Policy or applicable data protection laws.

Important: Please be aware that changing or deleting information in your Fizen Account may disable certain functionalities or features of the Platform, suspend portions of the Services, or affect transactions in progress. Fizen will not be held liable for any loss resulting from such changes.

Security of Your Personal Data

How Long We Keep Your Personal Data

We retain your personal data for as long as it is necessary to provide you with the Fizen Platform and/or Services. Where we no longer need your data to provide the service, we retain it only for as long as we have a legitimate business purpose — such as compliance with our legal obligations, or to establish, exercise, or defend legal claims.

After you have terminated your use of the Fizen Platform and/or Services, we will either delete your data or store it in an aggregated and anonymised format, without further notice to you.

Children and Minors

The Fizen Platform and Services are not directed at, or intended for use by, any person under the age of 18. We do not knowingly collect personal information from anyone under 18 years of age. In certain jurisdictions, this minimum age may be higher due to local regulatory requirements.

If you are a parent or guardian and believe that we have collected personal data about your child or minor under the applicable minimum age, please contact us immediately. We will delete the relevant information promptly upon completing our verification.

(c) Sending a message to your Fizen Account; or

If you do not agree to the updated Policy, you may not be able to continue accessing the Fizen Platform or using the Services. Your continued access or use after the effective date of any update constitutes your acceptance of the revised Policy.

Governing Law
